Analysis
The trial court accepted guilty pleas in two cases, denied a motion to replace appointed counsel, and imposed a four-year prison sentence with fees and fines. The Court of Appeal affirmed the judgment after an independent review of the record pursuant to People v. Wende found no arguable issues for reversal.
| Ruling reviewed | Standard | The court | The model |
|---|---|---|---|
Denial of motion to replace appointed counsel“Did the court properly deny the motion to replace appointed counsel?” | unclear | not reached | unsure The appellate court listed this as a potential issue identified by counsel but stated it had not discovered any arguable issues for reversal after independent review, without providing specific analysis or applying a standard of review to this specific ruling. |
Imposition of fees and fines“Did the court properly impose various fees and fines as part of the sentence?” | unclear | not reached | unsure The appellate court listed this as a potential issue identified by counsel but stated it had not discovered any arguable issues for reversal after independent review, without providing specific analysis or applying a standard of review to this specific ruling. |
Guilty plea validity (ability to hear court's questions)“Does the record show that Estrada was able to hear the court’s questions about Estrada’s understanding of the trial rights he waived in pleading guilty?” | unclear | not reached | unsure The appellate court listed this as a potential issue identified by counsel but stated it had not discovered any arguable issues for reversal after independent review, without providing specific analysis or applying a standard of review to this specific ruling. |
Authorities
- relied: People v. Wende (1979) 25 Cal.3d 436 — Requires independent review of the record by the court when appointed appellate counsel finds no arguable issues.
The appellate opinion: sound with gaps — The opinion is a standard Wende/Anders brief where the court states it reviewed the record and found no arguable issues. It does not address the specific merits of the three potential issues raised by counsel, nor does it apply specific standards of review to the trial court's rulings on the motion to replace counsel or the imposition of fees.

unusual disposition unusual dispositionThe trial court accepted Estrada's guilty pleas to robbery with a weapon-use admission and to shoplifting, denied his pre-sentencing motion to replace appointed counsel, and imposed a stipulated four-year prison term with fines and fees. On appeal, counsel filed a Wende brief identifying three possible issues, Estrada filed no supplemental brief, and the Court of Appeal independently reviewed the record, found no arguable issues, and affirmed.
| Ruling reviewed | Standard | The court | The model |
|---|---|---|---|
Acceptance of guilty pleas and waiver of trial rights (whether the record shows Estrada could hear the court's advisements)“Does the record show that Estrada was able to hear the court’s questions about Estrada’s understanding of the trial rights he waived in pleading guilty?” | unclear | correct | unsure The opinion lists this as a possible issue flagged by counsel but gives no description of the plea colloquy or the record on Estrada's ability to hear; it simply states that independent Wende review disclosed no arguable issue. Without any recited facts, the result cannot be independently verified, though nothing in the opinion suggests error. |
Denial of motion to replace appointed counsel (Marsden motion) after hearing“Prior to sentencing, Estrada filed a motion to replace appointed counsel. The court held a hearing and then denied the motion.” | unclear | correct | unsure The trial court held a hearing before denying the motion, which satisfies the core procedural requirement for such motions, and the Court of Appeal found no arguable issue on independent review. The opinion does not cite Marsden or state the abuse-of-discretion standard, and recites nothing about what was said at the hearing, so the conclusion cannot be checked against the record. |
Imposition of fines and fees as part of the stipulated sentence“Did the court properly impose various fees and fines as part of the sentence?” | unclear | correct | unsure The opinion identifies the fines and fees as a potential issue but does not list the amounts, the statutory bases, or whether any ability-to-pay objection was made. The Wende review found no arguable issue; given the absence of detail, there is no basis to disagree, but equally no basis to confirm. |
Authorities
- relied: People v. Wende (1979) 25 Cal.3d 436 — When appointed appellate counsel finds no arguable issues, the Court of Appeal must independently review the entire record for error before affirming.
- relied: Anders v. California (1967) 386 U.S. 738 — Appointed counsel who finds an appeal wholly frivolous may so advise the court and request to withdraw, accompanied by a brief referring to anything in the record that might arguably support the appeal, and the court must then conduct its own examination of the record.
- missed: People v. Kelly (2006) 40 Cal.4th 106 — A Wende opinion should contain a brief description of the facts and procedural history, the crimes of conviction, and the punishment imposed, and must address any contentions raised in a defendant's supplemental brief; the court here expressly declined to include a statement of facts.
- missed: People v. Marsden (1970) 2 Cal.3d 118 — When a defendant seeks to replace appointed counsel, the trial court must permit the defendant to state the reasons for the request and must grant substitution if counsel is providing inadequate representation or an irreconcilable conflict exists; denial is reviewed for abuse of discretion.
The appellate opinion: sound with gaps — The opinion follows the Wende procedure correctly—counsel identified possible issues, the defendant was invited to file a supplemental brief and did not, and the court independently reviewed the record—so the affirmance is defensible. It nonetheless omits any statement of facts contrary to Kelly's guidance, and cites neither Marsden nor any authority or standard for the three issues it lists, leaving the reader unable to evaluate the conclusions.

COURT OF APPEAL, FOURTH APPELLATE DISTRICT
DIVISION ONE
STATE OF CALIFORNIA
THE PEOPLE, D087122
Plaintiff and Respondent, (Super. Ct. Nos. SCE433060, SCD307798) v.
RAFAEL ESTRADA,
Defendant and Appellant.
APPEAL from a judgment of the Superior Court of San Diego County, Selena Dong Epley, Judge. Affirmed. Ava R. Stralla, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance by Plaintiff and Respondent. Rafael Estrada entered into plea agreements which resolved two pending cases. In case No. SCE433060, Estrada pleaded guilty to robbery (Pen. Code, § 211) and admitted the use of a weapon. In case No. SCD307798 Estrada pleaded guilty to shoplifting. Prior to sentencing, Estrada filed a motion to replace appointed counsel. The court held a hearing and then denied the motion. The court sentenced Estrada to a total term for both cases of four years in prison. The charges that were not admitted were dismissed as part of the plea agreement. Estrada fled a timely notice of appeal and obtained a certificate of probable cause. Appellate counsel has filed a brief under the authority of People v. Wende (1979) 25 Cal.3d 436 (Wende) indicating counsel has not been able to identify any arguable issues for reversal on appeal. Counsel asks the court to independently review the record for error as mandated by Wende. We offered Estrada the opportunity to file his own brief on appeal, but he has not responded and has not filed any supplemental briefing. This case follows guilty pleas in two cases with stipulated sentences. We will not include a statement of facts in this opinion. DISCUSSION As we have noted, appellate counsel has filed a Wende brief and asks the court to independently review the record for error. To assist the court in its review of the record, counsel has identified three possible issues that were considered in evaluating the potential merits of this appeal. Does the record show that Estrada was able to hear the court’s questions about Estrada’s understanding of the trial rights he waived in pleading guilty? Did the court properly deny the motion to replace appointed counsel? Did the court properly impose various fees and fines as part of the sentence? We have independently reviewed the record for error as required by Wende and Anders. We have not discovered any arguable issues for reversal on appeal. Competent counsel has represented Estada in this appeal.
2 DISPOSITION The judgment is affirmed.
