Motion to withdraw as counsel denied without prejudice“Consequently, the Court DENIES their motion without prejudice to renewal upon a sufficient showing of entitlement to the relief they seek.” | agree with court The court correctly applied the standard that withdrawal is discretionary and requires a showing of good cause. The order notes that the motion contained only a conclusory statement that the client made representation 'unreasonably difficult' without supporting facts. Denying the motion without prejudice is a standard procedural response to an insufficiently supported motion, allowing the attorneys to refile with the necessary factual details while protecting the client's right to counsel and the court's docket management. |
The order itself: sound — The order is procedurally sound. It correctly identifies the legal standard for withdrawal (discretionary, requires leave) and the relevant factors. It identifies the specific deficiency in the plaintiff's motion (lack of factual support) and provides clear instructions for renewal. It also appropriately raises the issue of whether other attorneys are joining the withdrawal to ensure the client is not left without representation or to clarify the scope of the request.
