Analysis

A model's reading — qwen3.8-27b, prompt own-v1, 2026-10-13T21:58Z · confidence high

The court dismissed the plaintiff's civil action without further leave to amend because she failed to file an amended complaint or seek an extension after a prior dismissal with leave to amend. The court directed the Clerk to enter final judgment and close the file.

What the court decidedThe model
Dismissal of the civil action in its entirety without further leave to amend
“Accordingly, the Court DISMISSES this civil action in its entirety without further leave to amend based on Plaintiff’s failure to state a claim upon which relief can be granted and her failure to prosecute pursuant to Federal Rule of Civil Procedure 41(b).”
agree with court
The order recites that the court previously dismissed the complaint with leave to amend by a specific deadline. It further recites that the plaintiff did not file an amended complaint, did not seek an extension, and did not file a new IFP motion within the time allowed. Under Ninth Circuit precedent, a district court may convert a dismissal with leave to amend into a dismissal of the entire action when the plaintiff fails to comply with the court's deadline to amend. The court's decision follows directly from the procedural history and the cited authorities.

The order itself: sound — The order is procedurally sound. It correctly identifies the prior order granting leave to amend, notes the plaintiff's inaction (failure to amend, seek extension, or re-file IFP), and applies the correct Ninth Circuit authority for converting a dismissal with leave to amend into a dismissal of the action for failure to prosecute under Rule 41(b). The reasoning is concise and directly addresses the procedural default.
