Granting Plaintiff's unopposed motion to continue the Early Neutral Evaluation and Case Management Conference (ENE/CMC).“Accordingly, the Court ORDERS the ENE/CMC shall be continued to July 3, 2023, at 2:00 p.m.” | disagree with court · procedure The court explicitly states that it finds no good cause to grant the motion because the request was not raised within 10 days of the previous order, as required by Chambers' Rules. However, the court proceeds to grant the motion based on its 'general discretion.' While district courts possess broad discretion over scheduling matters, the order fails to articulate any specific factors or reasons supporting the exercise of that discretion in the face of a clear procedural violation (failure to meet the 10-day deadline). The decision to grant the motion despite the lack of good cause is not supported by the reasoning provided in the text. |
The order itself: questionable — The order is procedurally questionable. The court cites a specific local rule (Chambers' Rules, Section II(B)) requiring requests for continuance based on preexisting conflicts to be raised within 10 days. The court explicitly finds that the Plaintiff failed to meet this deadline and therefore found 'no good cause.' Despite this finding, the court grants the motion based on 'general discretion' without providing any factual basis or legal justification for overriding the specific procedural requirement. The reasoning does not logically support the result; if the specific rule for continuances was violated and no good cause was found, the general discretion should not be exercised to grant the motion without further explanation.
