The court reviewed Plaintiff's Second Amended Complaint after he failed to correct identified deficiencies despite two prior opportunities to amend. The court dismissed the complaint with prejudice, finding that further amendment would be futile.

What the court decidedThe model
Dismissal of Plaintiff's Second Amended Complaint with prejudice and without leave to amend
“Because the Court finds that further opportunities to amend would be futile to cure, the Court DISMISSES Plaintiff's Second Amended Complaint without leave to amend and with prejudice.”
agree with court
The order cites Lucas v. Dep’t of Corr. for the proposition that dismissal with prejudice is appropriate when it is clear that amendment could not cure the defects. The court states that it gave the plaintiff two opportunities to correct deficiencies and that he failed to do so, leading to the finding of futility. While the specific nature of the 'deficiencies' is not detailed in the order, the procedural history (two prior chances) and the cited authority support the conclusion that dismissal with prejudice is a permissible outcome when amendment is futile. The decision follows from the law and the procedural record recited in the order.

The order itself: sound with gaps — The order correctly applies the standard from Lucas v. Dep’t of Corr. by linking the dismissal with prejudice to a finding of futility. It recites the procedural history (two prior opportunities to amend) which supports the futility finding. However, it does not specify what the 'deficiencies' were, which is a gap in the reasoning, but the result is defensible based on the cited authority and the stated procedural history.

Opinion

a 7 United States District Court SOUTHERN DISTRICT OF CALIFORNIA Joshua Paul Santana Civil Action No. — 21cv0406-JO-JLB Plaintiff, V. John C. Hemmerling; Mara W. Elliott; JUDGMENT IN A CIVIL CASE Carol Mendoza Defendant.

Decision by Court. This action came to trial or hearing before the Court. The issues have been tried or heard and a decision has been rendered. IT IS HEREBY ORDERED AND ADJUDGED: The Court has explained the complaint’s deficiencies to Plaintiff and granted him two opportunities to correct them. Plaintiff has failed to do so each time and it does not appear that he will be able to do so with future opportunities. Lucas v. Dep’t of Corr., 66 F.3d 245, 248 (9th Cir. 1995) (a court dismisses with prejudice only when it is clear that amendment could not cure the defects). Because the Court finds that further opportunities to amend would be futile to cure, the Court DISMISSES Plaintiff's Second Amended Complaint without leave to amend and with prejudice.
