Joint Motion to Dismiss with Prejudice granted“Having considered the parties’ request, the Court GRANTS the Joint Motion. (ECF No. 30.) Thus, the Court DISMISSES WITH PREJUDICE the instant action.” | agree with court The parties filed a stipulation compliant with Rule 41(a)(1)(A)(ii) and explicitly requested dismissal with prejudice. The court correctly applied the local rule requiring such stipulations to be filed as a joint motion and granted the request as made. The decision follows directly from the parties' agreement and the cited procedural rules. |
The order itself: sound — The order correctly identifies the procedural mechanism for voluntary dismissal by stipulation, cites the relevant federal rules and Ninth Circuit authority, and acknowledges the local rule requirement for filing such stipulations as a joint motion. The result (dismissal with prejudice) is exactly what the parties requested in their compliant stipulation. The reasoning is complete and accurate for this procedural posture.
