The court reviewed a pro se prisoner's civil rights complaint that was filed without the required filing fee or a motion to proceed in forma pauperis. The court dismissed the action without prejudice and granted the plaintiff thirty days to pay the fee or file the required motion.

What the court decidedThe model
Dismissal of the action without prejudice for failure to pay the filing fee or file a motion to proceed in forma pauperis.
“IT IS HEREBY ORDERED that this action is dismissed without prejudice for Plaintiff’s failure to pay the $402 civil filing and administrative fee or submit a motion to proceed IFP pursuant to 28 U.S.C. §§ 1914(a) and 1915(a).”
agree with court
The dismissal is procedurally correct because 28 U.S.C. § 1914(a) requires the payment of the filing fee, and 28 U.S.C. § 1915(a) provides the mechanism for waiver. The order correctly identifies that the plaintiff failed to satisfy either requirement. Granting leave to cure the defect within 30 days is a common and appropriate procedural step in this context.

The order itself: sound — The order correctly applies the statutory requirements for filing fees and IFP status. It cites the relevant Ninth Circuit precedent and statutes. The procedural remedy of dismissal without prejudice with leave to cure is standard and appropriate.
