Plaintiff Mary R. filed an application to proceed in forma pauperis in a Social Security action. The court granted the application, finding that the plaintiff demonstrated an inability to pay the filing fee while maintaining the necessities of life.

What the court decidedThe model
Application to Proceed in Forma Pauperis Granted
“Accordingly, Plaintiff's Application Proceed with her Complaint in forma pauperis is GRANTED.”
agree with court
The court correctly applied the statutory standard of 28 U.S.C. § 1915(a) and the controlling Ninth Circuit precedent. The affidavit recited specific facts: unemployment, low public assistance income ($401/month), minimal assets (one car), and expenses ($740/month) exceeding income. This satisfies the requirement that the applicant show an inability to pay the fee and still provide for the necessities of life. The decision follows logically from the recited record and the cited law.

The order itself: sound — The order is procedurally correct and substantively sound. It cites the correct statutory authority and binding case law from the Ninth Circuit and the Supreme Court. The factual findings (income, expenses, assets) are explicitly stated and directly support the legal conclusion that the plaintiff meets the IFP standard. There are no gaps in reasoning or missing authorities.
