Analysis

A model's reading — qwen3.8-27b, prompt own-v1, 2026-10-13T22:43Z · confidence high

Defendants moved to dismiss the original complaint under Rules 12(b)(1) and 12(b)(6) after removing the case to federal court. The court denied the motion as moot because Plaintiffs filed a first amended complaint, which superseded the original complaint targeted by the motion.

What the court decidedThe model
Defendants' Motion to Dismiss as Moot
“In light of Plaintiffs’ amended pleading, Court denies as moot Defendants’ motion to dismiss the complaint without prejudice Defendants moving to dismiss the first amended complaint.”
agree with court
The decision follows the well-established procedural rule that an amended complaint supersedes the original complaint, rendering a motion to dismiss the original complaint moot. The court correctly cited Ninth Circuit authority (Ramirez) supporting this proposition. The denial is without prejudice, allowing Defendants to re-file a motion against the new pleading if they choose.

The order itself: sound — The order is procedurally sound. It correctly identifies that the filing of the First Amended Complaint (FAC) superseded the original complaint, thereby rendering the pending motion to dismiss the original complaint moot. The court relies on appropriate Ninth Circuit precedent to support this procedural conclusion. There are no gaps in the reasoning regarding the specific procedural posture presented.
