Analysis
Following a status conference in a patent litigation case, the court lifted a previously imposed stay and ordered the plaintiff to show cause why it should be allowed to reassert claims that were not selected in a prior order. The court set a briefing schedule for the parties to address the issue of claim reassertion.
| What the court decided | The model |
|---|---|
Lifted the stay imposed in the Court’s October 23, 2020 Order“The stay imposed in the Court’s October 23, 2020 Order (ECF No. 1491) is lifted.” | unsure The order does not provide the factual or legal basis for lifting the stay, only noting that it was done after a status conference. Without the underlying reasons, it is impossible to verify if the decision was legally sound. |
Ordered Ameranth to show cause why it should be allowed to reassert claims not selected in the February 14, 2017 Order“Ameranth is ordered to show cause why it should be allowed to reassert any claims that were not selected in response to the Court’s February 14, 2017 Order.” | agree with court The court cites Federal Circuit precedent (In re Katz and Nuance) regarding claim selection and reassertion. The order to show cause is a procedural mechanism to determine if the plaintiff can revive previously dropped claims, which is a standard exercise of judicial management in patent cases to prevent claim proliferation. The citation to controlling Federal Circuit law supports the procedural step. |
The order itself: sound with gaps — The order is a short procedural directive following a status conference. It correctly cites relevant Federal Circuit precedent for the specific issue of claim reassertion. However, it provides no reasoning for lifting the stay, which is a significant procedural change. The reasoning for the show cause order is implicit in the citations, which is acceptable for a brief order but leaves the stay decision unexplained.
