The parties filed a joint motion to remand the action to San Diego County Superior Court to facilitate a global settlement and consolidation with related state proceedings. The court granted the motion and ordered the case remanded and closed.

What the court decidedThe model
Joint Motion to Remand [Dkt. 104] is granted.
“The parties’ motion is GRANTED, and this action is REMANDED to San Diego County Superior Court.”
agree with court
The court accepted the parties' argument that it lacked authority to independently review the fairness of a global settlement reached in another court, citing the Anti-Injunction Act and the Ninth Circuit's decision in Negrete v. Allianz Life Ins. Co. By remanding the case to state court, the federal court avoids the jurisdictional conflict of approving a settlement that encompasses claims in other forums, which aligns with the principles of comity and the Anti-Injunction Act.

The order itself: sound — The order relies on a specific Ninth Circuit precedent (Negrete) to support the procedural mechanism of remand to avoid the Anti-Injunction Act. The reasoning is concise but directly addresses the jurisdictional issue raised by the court's earlier order for briefing. It correctly identifies that the federal court's role is limited when a global settlement is being adjudicated elsewhere.

On January 10, 17 2020, the parties jointly moved to stay this action while they finalized a joint dismissal as 18 part of that global settlement. Given that the Court had already certified a limited class, 19 the Court ordered additional briefing as to whether it had authority to grant a joint 20 dismissal without being independently satisfied that the global settlement (reached in 21 another court but encompassing the claims at issue here) was fair. The parties submitted 22 the required briefing1 and now move to remand this action to San Diego County Superior 23 Court, where it will be consolidated with related state court proceedings and the global 24 25 1 Relying on the Ninth Circuit’s decision in Negrete v.
