Analysis

A model's reading — qwen3.8-27b, prompt v1, 2026-10-13T04:44Z · confidence low

The trial court ordered the defendant to pay $27,556.38 in restitution following a plea agreement and a restitution hearing. The Court of Appeal affirmed the judgment after an independent review of the record pursuant to People v. Wende, finding no arguable issues for reversal.

Order requiring defendant to pay $27,556.38 in restitution to the City of Brawley.
“At the conclusion of the hearing, the court ordered Gomez to pay restitution in the amount of $27,556.38.”
unclearnot reachedunsure
The appellate court did not apply a specific standard of review (such as abuse of discretion) to the restitution order. Instead, it conducted an independent review of the entire record as mandated by People v. Wende and Anders v. California, concluding that no arguable issues for reversal existed. Because the court found no error to address, it did not explicitly evaluate the trial court's application of the law, rendering the specific standard of review unclear from the text.

Authorities

  • relied: People v. Wende (1979) 25 Cal.3d 436 — Requires appointed appellate counsel to identify arguable issues or file a brief explaining why none exist, and mandates the court to independently review the record for error.
  • relied: Anders v. California (1967) 386 U.S. 738 — Establishes the procedure for appointed counsel to withdraw from representation on appeal when no arguable issues exist, requiring a brief identifying potential issues and court review.
  • relied: People v. Harvey (1979) 25 Cal.3d 754 — Defines the requirements for a valid waiver of the right to a jury trial in a criminal case.

The appellate opinion: sound with gaps — The opinion is procedurally sound as it correctly follows the Wende/Anders protocol for reviewing a case where counsel identifies no arguable issues. However, it is a 'sound with gaps' analysis because it fails to articulate the specific standard of review (e.g., abuse of discretion) that would apply to the restitution order, relying solely on the negative finding of 'no arguable issues' without substantive legal analysis of the restitution statute or evidence.

The Imperial County Superior Court accepted Gomez's no contest plea to receiving stolen property with a Harvey waiver, suspended a three-year county jail sentence, granted probation, and after a contested restitution hearing ordered him to pay $27,556.38 in victim restitution to the City of Brawley. On appeal, appointed counsel filed a Wende/Anders brief identifying the restitution order as the only possible issue, Gomez filed no supplemental brief, and the Court of Appeal independently reviewed the record, found no arguable issue, and affirmed.

Order after contested restitution hearing requiring Gomez to pay $27,556.38 in victim restitution to the City of Brawley

unclearcorrectunsure
The opinion does not articulate a standard of review; it conducts an independent Wende/Anders review of the record and states only that no arguable issue exists. The opinion recites that the trial court held a hearing, considered the probation report, police reports, party documents, and witness testimony before setting an amount slightly below the probation officer's recommendation, which is consistent with a proper exercise of discretion under Penal Code section 1202.4. Because the opinion gives no detail about the evidence or Gomez's objections, I cannot verify the amount, but nothing in the opinion suggests legal error.

Authorities

  • relied: People v. Wende (1979) 25 Cal.3d 436 — When appointed appellate counsel finds no arguable issues, the Court of Appeal must independently review the entire record for arguable error before affirming.
  • relied: Anders v. California (1967) 386 U.S. 738 — Appointed counsel who finds an appeal wholly frivolous may so advise the court but should identify anything in the record that might arguably support the appeal.
  • relied: People v. Harvey (1979) 25 Cal.3d 754 — Absent a waiver, a sentencing court may not consider facts underlying dismissed counts; a Harvey waiver permits consideration of such facts, including for restitution.

The appellate opinion: sound with gaps — The opinion follows the standard Wende/Anders procedure: it notes counsel's brief, the issue counsel flagged, the invitation to Gomez to file his own brief, and the court's independent review of the record, and it affirms upon finding no arguable issue. It is defensible but minimal, offering no description of the restitution evidence or of why the order was within the court's discretion, so a reader cannot independently evaluate the result.

COURT OF APPEAL, FOURTH APPELLATE DISTRICT

DIVISION ONE

STATE OF CALIFORNIA

THE PEOPLE, D079761

Plaintiff and Respondent, v. (Super. Ct. No. JCF004169)

CIPRIANO GOMEZ,

Defendant and Appellant.

APPEAL from a judgment of the Superior Court of Imperial County, Christopher J. Plourd, Judge. Affirmed. Alex Kreit, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent. Cipriano Gomez entered into a plea agreement, under which he pleaded no contest to receiving stolen property (Pen. Code,1 § 496, subd. (a)) with a 1 All further statutory references are to the Penal Code. Harvey2 waiver. He was sentenced to a three-year term in county jail. The sentence was suspended, and Gomez was granted probation. The probation officer recommended that Gomez be ordered to pay restitution to the City of Brawley in the amount of $27,656.38. Gomez requested a restitution hearing. His request was granted. At the restitution hearing, the court considered the probation report, police reports, documents supplied by the parties, and heard testimony from witnesses. At the conclusion of the hearing, the court ordered Gomez to pay restitution in the amount of $27,556.38. Gomez appealed, challenging only the restitution order. Appellate counsel has filed a brief pursuant to People v. Wende (1979) 25 Cal.3d 436 (Wende) indicating counsel has not been able to identify any arguable issues for reversal on appeal. Counsel asks the court to review the record for error as mandated by Wende. We offered Gomez the opportunity to file his own brief on appeal, but he has not responded.

DISCUSSION3 As we have noted, appellate counsel has filed a Wende brief and asks the court to review the record for error. To assist the court in its review, and in compliance with Anders v. California (1967) 386 U.S. 738 (Anders), counsel has identified the following possible issue that was considered in evaluating the potential merits of this appeal: Whether the trial court erred in issuing the restitution order in this case.

2 People v. Harvey (1979) 25 Cal.3d 754. 3 Given the limited scope of this appeal, we find it unnecessary to discuss the facts of the offenses in this case. 2 We have reviewed the entire record as required by Wende and Anders. We have not discovered any arguable issues for reversal on appeal. Competent counsel has represented Gomez on this appeal. DISPOSITION The judgment is affirmed.
