The court reviewed a special master's recommendation regarding the status of Weeks Poultry Community, Inc. under the Bankruptcy Act. The court held that the entity was not a moneyed, business, or commercial corporation and adopted the special master's recommendations.

What the court decidedThe model
Adoption of special master's recommendations and determination that the alleged bankrupt is not a moneyed, business, or commercial corporation.
“The recommendations of the special master are therefore adopted, and counsel for the alleged bankrupt will prepare a decree accordingly.”
agree with court
The court relies on the precedent set in In re Dairy Marketing Ass’n of Ft. Wayne, Inc., which holds that an association whose primary business is not commercial or moneyed does not qualify as a 'moneyed, business, or commercial corporation' under the Bankruptcy Act. The court finds the facts analogous, noting that other business was merely incidental. This application of the cited precedent to the facts recited is legally sound.

The order itself: sound with gaps — The order is extremely brief and provides no factual background regarding the specific activities of Weeks Poultry Community, Inc. It relies entirely on a single district court precedent (In re Dairy Marketing Ass’n) without explaining why the facts of the current case are sufficiently similar to that precedent. While the result may be correct, the reasoning is conclusory and lacks the necessary factual analysis to demonstrate that the 'incidental' business test was properly applied to this specific record.

Opinion — Cosgrave

COSGRAVE, District Judge.

From a study of this case I am of the opinion that the alleged bankrupt is not a moneyed, business, or commercial corporation within the meaning of the United Stated Bankruptcy Act (11 USCA), and that In re Dairy Marketing Ass’n of Ft. Wayne, Inc. (D. C.) 8 F.(2d) 626, clearly decides the question. The other business, if it could be called sueh, transacted, was merely incidental to the main business of the association.

The recommendations of the special master are therefore adopted, and counsel for the alleged bankrupt will prepare a decree accordingly.
