Analysis

A model's reading — qwen3.8-27b, prompt own-v1, 2026-10-13T20:28Z · confidence high

The court reviewed a pro se petition for a writ of habeas corpus filed by Miguel Nava Paredes and found it duplicative of a previously filed petition in which the petitioner is represented by counsel. The court dismissed the petition without prejudice and terminated the pending motions as moot.

What the court decidedThe model
Dismissal of Petition for Writ of Habeas Corpus
“Therefore, the Court DISMISSES WITHOUT PREJUDICE the Petition. (ECF No. 1.)”
agree with court
The court correctly identified that the instant petition was duplicative of a pending action (No. 26-cv-03462) where the petitioner is already represented by counsel. Dismissing the duplicative pro se filing without prejudice is a standard procedural mechanism to prevent parallel proceedings and ensure the petitioner's claims are adjudicated in the single pending case. The court's reasoning is consistent with general federal practice regarding duplicative habeas petitions.
Termination of Motion for Leave to Proceed In Forma Pauperis
“The Court also TERMINATES AS MOOT the Motion for Leave to Proceed In Forma Pauperis (ECF No. 2)”
agree with court
Because the underlying petition was dismissed, the motion for leave to proceed in forma pauperis is no longer necessary for this specific case. Terminating it as moot is procedurally correct.
Termination of Motion to Appoint Counsel
“and the Motion to Appoint Counsel (ECF No. 3).”
agree with court
The court noted that the petitioner already has counsel in the pending duplicative case. Therefore, the motion to appoint counsel in this dismissed case is moot. This is a logical and correct procedural step.

The order itself: sound — The order is concise and directly addresses the procedural issue of duplicative filings. It correctly cites a relevant district court case for the proposition that duplicative habeas petitions can be dismissed. The court's decision to dismiss without prejudice allows the petitioner to continue pursuing relief in the proper, pending case, which is the appropriate outcome. There are no significant gaps in the reasoning for this procedural dismissal.

FOR WRIT OF HABEAS CORPUS (ECF No. 1) 16 JEREMY CASEY, Warden, 17 Respondent. 18 19 20 Petitioner Miguel Nava Paredes filed a Petition for Writ of Habeas Corpus pursuant 21 to 28 U.S.C. § 2241. (ECF No. 1.) Upon review, the Court notes that Petitioner recently 22 filed a Section 2241 Petition with the aid of counsel in Paredes v. Casey, No. 26-cv-03462- 23 RBM-SBC (S.D. Cal. filed June 9, 2026). Judge Montenegro has issued an Order to Show 24 Cause in the earlier-filed Petition, and that case is awaiting further briefing before Judge 25 Montenegro renders her decision. 26 A habeas petition is subject to summary dismissal when it is repetitive or duplicative. 27 See, e.g., Salas v. Att’y Gen., No. 2:23-cv-01118-TL-TLF, 2023 WL 5826738, at *2 (W.D. 28 Wash. Aug. 21, 2023). Here, given that Petitioner filed this case by U.S. Mail due to his | || pro se status, it is unclear whether Petitioner realized his counsel had already filed a habeas 2 ||petition on his behalf. Regardless, however, this Petition is duplicative. Petitioner may 3 ||continue to pursue habeas relief through counsel in the case pending before Judge 4 || Montenegro.
