| What the court decided | The model |
|---|---|
Granting Defendant's Motion to Compel Arbitration“ModMed’s Motion to Compel Arbitration is GRANTED (Doc. No. 11);” | agree with court The district court is bound by the Ninth Circuit's mandate to grant the motion. The decision follows directly from the appellate court's instruction. |
Staying the action pending arbitration“This matter is STAYED pending resolution of the arbitration;” | agree with court The stay is a standard procedural mechanism to prevent duplicative litigation while arbitration proceeds, as instructed by the Ninth Circuit. |
The order itself: sound — The order is a ministerial implementation of a binding appellate mandate. It correctly identifies the controlling authority and executes the specific instructions provided by the Ninth Circuit.
