Ordering supplemental briefing and oral argument on the Joint Motion for Preliminary Approval of Class Action Settlement“IT IS HEREBY ORDERED THAT: 1. On or before April 17, 2026, the Beavers must file a supplemental brief... 2. On or before April 24, 2026, Omni must file a supplemental response brief... 3. The parties must appear before the undersigned to present argument...” | agree with court The court is exercising its discretion to ensure the record is sufficient to evaluate the settlement under Rule 23(e). The court identified specific concerns regarding the 'congruence' of interests between the class representatives and the class, citing that only the representatives are liable for attorney fees. Requesting briefing on this specific issue is a standard and appropriate procedural step to ensure the settlement meets the requirements of Rule 23(e)(2)(A) and (D). |
The order itself: sound — The order correctly identifies the relevant legal standards for preliminary approval of a class settlement under Rule 23(e). It cites binding Ninth Circuit precedent (Rodriguez and Molski) to support its concern that the class representatives' unique liability for attorney fees may create a conflict of interest with the rest of the class. The order does not decide the motion but appropriately requests further briefing to resolve this specific legal issue. The reasoning is sound and directly addresses the motion.
