Analysis
The court reviewed a pro se petition for a writ of habeas corpus and determined that while summary dismissal was not warranted, the petition lacked sufficient detail for meaningful consideration. The court referred the petition to Federal Defenders to evaluate the appointment of counsel and ordered them to file a status report or motion by April 2, 2026.
| What the court decided | The model |
|---|---|
Referral of Petition to Federal Defenders for evaluation of appointment of counsel“Accordingly, the Court REFERS this Petition to Federal Defenders for an evaluation of whether appointment of counsel would be beneficial to Petitioner.” | agree with court The court correctly identified that the petition was not frivolous enough for summary dismissal but was too vague for adjudication. Referring the case to Federal Defenders for a counsel evaluation is a standard and appropriate procedural mechanism in the Ninth Circuit for handling pro se habeas petitions that require assistance to be properly pleaded. |
Denial of summary dismissal“Having reviewed the Petition, the Court finds that summary dismissal of the Petition is unwarranted at this time.” | agree with court The court applied the correct standard for summary dismissal of a habeas petition, citing Kourteva and Hendricks. By finding the petition not 'vague or conclusory, palpably incredible, or patently frivolous or false,' the court properly declined to dismiss it at the threshold, instead opting for a referral to clarify the claims. |
The order itself: sound — The order is procedurally sound. It correctly applies the standard for summary dismissal and utilizes a common and effective procedural tool (referral to Federal Defenders) to assist a pro se petitioner in developing a viable claim. The reasoning is concise but sufficient for a procedural order.

Having reviewed 20 the Petition, the Court finds that summary dismissal of the Petition is unwarranted at this 21 time. See Kourteva v. INS, 151 F. Supp. 2d 1126, 1128 (N.D. Cal. 2001) (“Summary 22 dismissal is appropriate only where the allegations in the petition are vague or conclusory, 23 palpably incredible, or patently frivolous or false.”) (citing Hendricks v. Vasquez, 908 F.2d 24 490, 491 (9th Cir. 1990)). However, the Court finds that the Petition lacks sufficient detail 25 for the Court to meaningfully consider the requested relief. Accordingly, the Court 26 REFERS this Petition to Federal Defenders for an evaluation of whether appointment of 27 counsel would be beneficial to Petitioner. The Court requests that Federal Defenders make 28 its evaluation and file a status report or appropriate motion, e.g., an amended petition, by 1 || April 2, 2026.
