Analysis
The court reviewed a habeas corpus petition filed by an ICE detainee seeking a bond hearing and determined that summary dismissal was unwarranted. The court ordered the respondents to show cause why the petition should not be granted, set a briefing schedule, and issued a limited stay enjoining the removal of the petitioner from the district to preserve the status quo.
| What the court decided | The model |
|---|---|
Denial of summary dismissal of the Petition for a Writ of Habeas Corpus“Having reviewed the Petition, the Court finds that summary dismissal is unwarranted at this time.” | agree with court The court applied the standard from Hendricks v. Vasquez, which requires that allegations be vague, conclusory, palpably incredible, or patently frivolous to warrant summary dismissal. The court found the petition met the threshold to proceed, which is a standard procedural determination in habeas cases. |
Ordering Respondents to Show Cause and setting a briefing schedule“Respondents are ORDERED TO SHOW CAUSE why the Petition should not be granted by filing a written Return on or before February 26, 2026.” | agree with court This is a standard procedural step in a habeas corpus action to allow the government to respond to the allegations before the court makes a substantive ruling. |
Issuance of a limited stay enjoining the removal of the Petitioner from the United States or the district“Respondents, their agents, employees, successors, attorneys, and all persons acting in active concert or participation with them are hereby ENJOINED from removing Petitioner from the United States or this district pending further order of the Court, to maintain the status quo to allow the Court to provide a reasoned decision.” | agree with court The court relied on the All Writs Act (28 U.S.C. § 1651) to preserve its jurisdiction over the pending matter. This is a recognized use of the All Writs Act to prevent the mootness of a habeas petition through the removal of the detainee. |
The order itself: sound — The order correctly identifies the procedural posture of a habeas petition, applies the correct standard for summary dismissal from Ninth Circuit precedent, and utilizes the All Writs Act appropriately to preserve jurisdiction. The reasoning is concise but sufficient for a procedural order.
