Analysis
The court reviewed a petition for a writ of habeas corpus filed by an ICE detainee alleging detention without a bond hearing in violation of 8 U.S.C. § 1226(a) and the Fifth Amendment. The court ordered the respondents to provide the petitioner with an individualized bond hearing within 14 days.

Order requiring an individualized bond hearing“The Court thus ORDERS Respondents to provide Petitioner an individualized bond hearing before an immigration judge pursuant to 8 U.S.C. § 1226(a) and its associated regulations within 14 days of the date of this order.” | agree with court The court's order follows directly from the respondents' acknowledgment that the petitioner is a member of a certified class entitled to bond hearings under the final judgment in Maldonado Bautista v. Santacruz. Because the respondents conceded the petitioner's entitlement to a bond hearing under 8 U.S.C. § 1226(a), the court's order to provide that hearing is a logical and legally sound conclusion based on the record presented. |
The order itself: sound with gaps — The order is procedurally sound and relies on the respondents' explicit concession and the final judgment of a sister district court. However, it is a very brief order that does not independently analyze the legal merits of the habeas petition or the specific statutory requirements of 8 U.S.C. § 1226(a), relying entirely on the class certification and the government's acknowledgment.
