The trial court revoked the defendant's probation and imposed a 365-day custody term. The Court of Appeal affirmed the judgment after an independent review of the record pursuant to a Wende brief.

Revocation of probation and imposition of 365 days in custody
“In July 2024, the court again revoked probation, and Hernandez was again placed on probation subject to 365 days in custody.”
unclearnot reachedunsure
The opinion is a Wende/Anders review where counsel identified no arguable issues. The court states it 'independently reviewed the record for error' and 'has not discovered any arguable issues for reversal.' It does not explicitly analyze the merits of the probation revocation or the custody term, nor does it state a specific standard of review (e.g., abuse of discretion) for these rulings. It simply affirms based on the absence of arguable error.

Authorities

  • relied: People v. Wende (1979) 25 Cal.3d 436 — Requires independent review of the record by the appellate court when appointed counsel files a Wende brief identifying no arguable issues.
  • relied: Anders v. California (1967) 386 U.S. 738 — Requires counsel to file a brief identifying potential issues and the court to independently review the record to ensure the appeal is not frivolous.

The appellate opinion: sound with gaps — The opinion is procedurally sound as a Wende review, correctly citing the required authorities (Wende and Anders) and stating that the court performed the mandated independent review. However, it provides no substantive legal analysis or reasoning for affirming the specific probation revocation and custody term, relying solely on the negative finding of 'no arguable issues.'

The trial court revoked Michael Hernandez's probation in July 2024 for a second time and reinstated him on probation subject to 365 days in custody, following his 2022 guilty plea to assault with force likely to cause great bodily injury (Pen. Code, § 245, subd. (a)(4)). On appeal, appointed counsel filed a Wende brief identifying two possible issues (custody credits and reasonableness of probation conditions), Hernandez filed no supplemental brief, and the Court of Appeal independently reviewed the record, found no arguable issues, and affirmed.

Order revoking probation and reinstating Hernandez on probation subject to 365 days in custody
“In July 2024, the court again revoked probation, and Hernandez was again placed on probation subject to 365 days in custody.”
unclearcorrectunsure
The opinion applies only the Wende/Anders independent-review procedure and does not describe the evidence supporting the violation finding or the terms imposed. Nothing in the opinion suggests error, but the record recited is too thin to confirm independently that the revocation and reinstatement were proper.
Calculation of custody credits on reinstatement of probation
“1. Whether Hernandez’s custody credits were properly calculated.”
unclearcorrectunsure
Counsel flagged credit calculation as a possible issue and the court found no arguable error after independent review, but the opinion states no credit figures or dates, so the correctness of the calculation cannot be checked from the opinion.
Imposition of probation conditions on reinstatement
“2. Whether the conditions of probation were reasonable.”
unclearcorrectunsure
The court found no arguable issue regarding the reasonableness of the probation conditions, but the conditions are not described in the opinion, so no independent assessment under the Lent framework is possible from this record.

Authorities

  • relied: People v. Wende (1979) 25 Cal.3d 436 — When appointed appellate counsel finds no arguable issues, the Court of Appeal must independently review the entire record for arguable error before affirming.
  • relied: Anders v. California (1967) 386 U.S. 738 — Appointed counsel who finds an appeal to lack merit must so advise the court and identify anything in the record that might arguably support the appeal, after which the court decides whether the appeal is wholly frivolous.

The appellate opinion: sound — The opinion follows the standard Wende/Anders procedure: it notes counsel's no-issue brief and the two possible issues identified, confirms Hernandez was given the opportunity to file a supplemental brief, and states the court independently reviewed the record and found no arguable issue. It does not discuss whether Wende review is even required for an appeal from a post-judgment probation revocation order (cf. People v. Delgadillo (2022) 14 Cal.5th 216), but conducting the review in any event cannot prejudice the defendant, and the opinion contains the brief procedural history People v. Kelly (2006) 40 Cal.4th 106 requires, so the result is defensible.

COURT OF APPEAL, FOURTH APPELLATE DISTRICT

DIVISION ONE

STATE OF CALIFORNIA

THE PEOPLE, D084584

Plaintiff and Respondent, v. (Super. Ct. No. SCN421466)

MICHAEL HERNANDEZ,

Defendant and Appellant.

APPEAL from a judgment of the Superior Court of San Diego County, Daniel F. Link, Judge. Affirmed.

Robert L. Hernandez, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent. In 2022, Michael Hernandez pleaded guilty to assault with force likely to cause great bodily injury (Pen. Code,1 § 245, subd. (a)(4)). Hernandez was placed on probation subject to various terms and conditions. In 2023, the 1 All statutory references are to the Penal Code. court revoked Hernandez’s probation for alleged violations. Hernandez was then reinstated to probation. In July 2024, the court again revoked probation, and Hernandez was again placed on probation subject to 365 days in custody. Hernandez filed a timely notice of appeal. Appellate counsel has filed a brief pursuant to People v. Wende (1979) 25 Cal.3d 436 indicating Counsel has not been able to identify any arguable issues for reversal on appeal. Counsel asks the court to independently review the record for error as mandated by Wende. We offered Hernandez the opportunity to file his own brief on appeal, but he has not responded. DISCUSSION As we have noted, appellate counsel has filed a Wende brief and asks the court to independently review the record for error. To assist the court in its review, and in compliance with Anders v. California (1967) 386 U.S. 738, counsel has identified two possible issues that were considered in evaluating the potential merits of this appeal. 1. Whether Hernandez’s custody credits were properly calculated. 2. Whether the conditions of probation were reasonable. We have independently reviewed the record for error as required by Wende and Anders. We have not discovered any arguable issues for reversal on appeal. Competent counsel has represented Hernandez on this appeal.

2 DISPOSITION The judgment is affirmed.
