The court considered a motion by Strategic Legal Practices, APC, to withdraw as counsel of record for Plaintiff April Howard due to a breakdown in the attorney-client relationship and the plaintiff's failure to communicate. The court granted the motion, ordering the attorney to notify the plaintiff and requiring the plaintiff to retain new counsel or proceed pro se by April 4, 2025, or face dismissal.

What the court decidedThe model
Motion to Withdraw as Counsel of Record for Plaintiff April Howard granted.
“Accordingly, the Court GRANTS Counsel’s Motion to Withdraw as Counsel of Record for Plaintiff April Howard as follows:”
agree with court
The court applied the four-factor test for attorney withdrawal (reasons, prejudice, harm to administration of justice, delay) and found that the plaintiff's failure to communicate since December 2024 constituted a valid reason for withdrawal. The court correctly noted that no prejudice or delay would result given the early stage of the case and lack of scheduled hearings. The court also verified compliance with local rules regarding service and declarations. The decision follows from the cited authorities and the recited facts.

The order itself: sound — The order correctly identifies the applicable standard (discretionary review of the four-factor test) and applies it to the specific facts (client non-communication, early stage of litigation, no scheduled hearings). It also correctly verifies compliance with local procedural rules (CivLR 83.3(f)). The reasoning is complete and supported by the cited district court authorities.

1 2 3 4 5 6 7 8 UNITED STATES DISTRICT COURT 9 SOUTHERN DISTRICT OF CALIFORNIA 10 11 APRIL HOWARD, Case No.: 24cv2099-LL-MMP 12 Plaintiff, ORDER GRANTING MOTION TO 13 v. WITHDRAW AS COUNSEL OF RECORD FOR PLAINTIFF 14 FCA US, LLC, 15 Defendant. [ECF No. 14] 16 17 18 On February 20, 2025, Strategic Legal Practices, APC, (“Counsel”) filed a motion 19 for leave to withdraw as counsel of record for Plaintiff April Howard (“Howard”). ECF 20 No. 14 (“Motion”). No opposition has been filed. The Court finds this matter suitable for 21 determination on the papers and without oral argument pursuant to Federal Rule of Civil 22 Procedure 78(b) and Civil Local Rule 7.1(d)(1). 23 Counsel attests that “a complete and irreparable breakdown of the attorney-client 24 relationship has occurred that has made it unreasonably difficult for [Counsel] to carry out 25 the representation effectively.” ECF No. 14 at 7. Counsel further attests that they made 26 numerous attempts—including eleven phone calls and four emails—to communicate with 27 Plaintiff since December 26, 2024 without success. Id. 28 / / / 1 “An attorney may not withdraw as counsel except by leave of court.” P.I.C. Int’l, 2 Inc. v. Gooper Hermetic, Ltd., No. 3:19-CV-00734-BEN-LL, 2020 WL 2992194, at *1 3 (S.D. Cal. June 4, 2020) (citation omitted). “The trial court has discretion whether to grant 4 or deny an attorney’s motion to withdraw in a civil case.” Osgood v. Main Streat Mktg., 5 LLC, No. 16CV2415-GPC(BGS), 2017 WL 7362740, at *1 (S.D. Cal. Mar. 27, 2017). “In 6 ruling on a motion to withdraw as counsel, courts consider: (1) the reasons why withdrawal 7 is sought; (2) the prejudice withdrawal may cause to other litigants; (3) the harm 8 withdrawal might cause to the administration of justice; and (4) the degree to which 9 withdrawal will delay the resolution of the case.” Leatt Corp. v. Innovative Safety Tech., 10 LLC, No. 09-CV-1301-IEG POR, 2010 WL 444708, at *1 (S.D. Cal. Feb. 2, 2010). Courts 11 have previously held that “[f]ailure to pay attorney’s fees can be a valid ground for 12 withdrawal.” Id. at *2. Moreover, there is no danger of prejudice, harm to the 13 administration of justice, or undue delay where there are no immediately scheduled 14 hearings, the case is still in early stages, and the relevant party has had sufficient notice of 15 the intent to withdraw. See Gurvey v. Legend Films, Inc., No. 09-CV-942-IEG (BGS), 2010 16 WL 2756944, at *1 (S.D. Cal. July 12, 2010). 17 A motion to withdraw must (1) be served on the adverse party and moving attorney’s 18 client and (2) include a declaration regarding service of the motion on those parties. 19 S.D. Cal. CivLR 83.3(f)(3). “Failure to make [service] as required . . . or to file the required 20 declaration of service will result in a denial of the motion.” S.D. Cal. CivLR 83.3(f)(3)(b). 21 The Court finds Counsel’s claims are valid reasons for withdrawal. Howard’s 22 cessation of communication with Counsel since late December 2024 has made it 23 unreasonably difficult for Counsel to carry out the representation effectively. See Osgood, 24 2017 WL 7362740, at *1 (granting counsel’s motion to withdraw due to defendants failing 25 to pay legal fees and refusing to communicate with counsel). Because there are no 26 immediately scheduled hearings and this case is in the early stage of litigation, there is no 27 danger of prejudice to other litigants, harm to the administration of justice, or undue delay. 28 See Gurvey, 2010 WL 2756944, at *1. The Court finds it is appropriate for Counsel to | |} withdraw as counsel for Howard because the relevant considerations weigh in their favor. 2 || Additionally, Counsel has met the requirements of Civil Local Rule 83.3(f) by including a 3 || declaration regarding service of the Motion on Howard and adverse parties and a certificate 4 || of service. A failure to comply with this Order may result in dismissal of this 15 || action for failure to follow a court order or failure to prosecute pursuant to Federal Rule of 16 || Civil Procedure 41(b). 17 IT IS SO ORDERED. 18 Dated: March 3, 2025 NO 19 DE 20 Honorable Linda Lopez 51 United States District Judge 22 23 24 25 26 27 28
