What the court decidedThe model
Set a follow-up video settlement conference for January 30, 2025, at 1:00 p.m.
“the Court SETS a follow-up video Settlement Conference (“SC”) for January 30, 2025, at 1:00 p.m.”
agree with court
The order is a procedural scheduling directive issued by a Magistrate Judge pursuant to the parties' discussions. It does not resolve any substantive legal dispute or motion, so the decision follows standard case management practices.
Required all named parties, representatives, and principal attorneys to appear via videoconference with full settlement authority.
“All named parties (including those who are indemnified by others), party representatives, including claims adjusters for insured defendants, as well as the principal attorney(s) responsible for the litigation, must participate in the video conference, and be legally and factually prepared to discuss and resolve the case.”
agree with court
The requirement for parties with settlement authority to attend mediation or settlement conferences is a standard procedural mechanism to facilitate resolution. The order correctly cites authority defining 'full settlement authority.'
Ordered counsel to submit participant names, email addresses, and telephone numbers by January 24, 2025.
“No later than January 24, 2025, counsel for each party shall send an e-mail to the Court... containing the following: (1) The name and title of each participant... (2) An e-mail address for each participant... and (3) A telephone number where each participant may be reached”
agree with court
This is a routine logistical deadline to ensure the court can distribute Zoom invitations and manage technical difficulties. It is a reasonable administrative order.

The order itself: sound — The order is a procedural scheduling order for a settlement conference. It does not apply substantive law to resolve a dispute but rather sets administrative rules for a future proceeding. The citations provided are standard definitions used in settlement conference orders to ensure the parties have the necessary authority to negotiate. The reasoning is appropriate for the type of order issued.

Pursuant to the 20 discussions with the parties, the Court SETS a follow-up video Settlement Conference 21 (“SC”) for January 30, 2025, at 1:00 p.m. All discussions at the SC will be informal, 22 off the record, privileged, and confidential. The following rules and deadlines apply: 23 a. Appearance via Videoconference Required: All named parties (including 24 those who are indemnified by others), party representatives, including claims adjusters 25 for insured defendants, as well as the principal attorney(s) responsible for the litigation, 26 must participate in the video conference, and be legally and factually prepared to discuss 27 and resolve the case. Counsel appearing without their clients will be cause for immediate 28 imposition of sanctions and may also result in the immediate termination of the 1 conference. 2 b.
