The court addressed an Order to Show Cause regarding Keith Klinger's pro se representation of the limited liability company defendant, U.S.A. Home Inspectors. The court ordered a 30-day stay to allow the LLC to retain counsel, warning that if no attorney appears, the court will rule on pending motions without considering Klinger's arguments on behalf of the LLC.

What the court decidedThe model
Stay of proceedings for 30 days to allow U.S.A. Home Inspectors to retain counsel
“Accordingly, the Court will stay the proceedings for thirty (30) days from the entry of this Order, providing U.S.A. Home Inspectors with time to retain an attorney and instruct the attorney to enter a notice of appearance in this action.”
agree with court
The court correctly identified that an LLC cannot appear pro se and that Klinger's filings on behalf of the LLC were improper. Staying the case to allow the entity to retain counsel is a standard procedural mechanism to ensure due process and proper representation before ruling on substantive motions like default judgment.
Exclusion of Klinger's pro se arguments on behalf of U.S.A. Home Inspectors
“The Court may not consider of Klinger’s pro se filings to the extent they were intended to present arguments on behalf of U.S.A. Home Inspectors.”
agree with court
This follows directly from the legal principle that corporations and LLCs must be represented by licensed attorneys in federal court. Since Klinger is not an attorney, his arguments on behalf of the LLC are legally ineffective.

The order itself: sound — The order correctly applies the well-established rule that artificial entities like LLCs must be represented by counsel. It cites appropriate Supreme Court and Ninth Circuit authority. The procedural remedy (stay to allow retention of counsel) is reasonable and standard. The order is concise but fully addresses the legal issue raised by the Order to Show Cause.

Home Inspectors. 8 (ECF No. 27.) 9 On August 16, 2024, Plaintiff filed “Plaintiff’s Notice of Dismissal Without 10 Prejudice,” moving to dismiss Klinger without prejudice. (ECF No. 28.) On the same day, 11 Plaintiff filed a “Motion to Strike Amended Reply to Motion for Default Judgment” 12 (“Motion to Strike”), requesting the Court strike Klinger’s Amended Reply (ECF No. 27) 13 because, in relevant part, “Defendant USA Home Inspectors LLC is a limited liability 14 company.
